“Bail is the rule, jail the exception” reflects the constitutional commitment towards protecting personal liberty. In recent years, the Supreme Court has appeared to give renewed force to this principle.In UOI vs KA Najeeb (2021) and Satender Kumar Antil vs CBI (2022), it reinforced that the right to a speedy trial and personal liberty must prevail over statutory bail restrictions where proceedings are indefinitely delayed.
